GENERAL REMARKS
These General Terms and Conditions govern orders and deliveries of products/items of the Online Shop of Parts World AG (referred to below as "Parts World"). These General Terms and Conditions are deemed to have been accepted when a shop customer places an order via partsworldshop.com and become an integral part of the respective contract concluded with the customer. Any deviating terms and conditions of the customer shall be subject to the written consent or explicit approval of Parts World.
FORMATION OF CONTRACT
Orders constitute a binding offer by the customer. We reserve the right to accept this offer at our discretion within eight weeks upon the customer making the offer (send date) by sending a confirmation of order or by sending to the customer the ordered merchandise within this time. We expressly reserve the right to only effect delivery to customers who accept our General Terms and Conditions.
PRICING / TERMS OF PAYMENT
All prices quoted in euros include value-added tax (VAT) at the currently applicable rate. All prices quoted in US dollars exclude VAT. Shipping and handling costs are not included in the prices indicated and are itemized and charged separately in the order process / shopping cart. Prices are subject to change at any time, particularly as the result of changes in transportation costs and foreign exchange rates.
In cases in which VAT is applicable, the customer is charged VAT at the currently applicable rate separately, per order and in accordance with the shipment destination, DDP (cf. Incoterms), the customer's credit card being debited upon shipment. Parts World AG assumes any customs duties.
Advantage to you, the customer: no additional unexpected costs are incurred when placing orders via partsworldshop.com.
The prices indicated in the Online Shop are exclusively in reference to the product ordered. Any other services involving Parts World and the Online Shop customer (e.g. consultation/advice; after-sales service; installation of the products/items ordered, etc.) and the associated remuneration will be agreed directly between Parts World and the customer and are as such rendered outside of this order and delivery process.
Payment options available: credit card; we only accept VISA and MasterCard.
MINIMUM ORDER
The minimum order value for each international order placed in the Online Shop is US$ 100.00 or EUR 100.00 depending on the shipping address. This minimum order requirement does not apply to orders for samples or orders subject to other conditions agreed with Parts World for an individual order.
DELIVERY TIMES / METHOD OF DELIVERY
Parts World can effect delivery for ordered items/products as long as supplies last. The following generally applies: All items in the Online Shop are shipped exclusively DDP (Incoterms) via FedEx International Priority.
Items with a green →stock status: these items are in stock and are made ready to ship within 24 hours if possible and, as a general rule, are shipped within 72 hours (depending on the destination). Partial deliveries can be effected only at the express request of the Online Shop customer, with subsequent delivery of the other delivery parts being subject to the payment again of VAT and shipping costs by the customer.
Items with an orange → stock status: this means that stocks are low and there might be a delay in delivery, although this occurs very seldom.
Items with a red ↓ stock status: this means that the delivery times indicated are estimated delivery times. If you wish to cancel your order for items ordered in the Online Shop on account of a delay in delivery, please contact us in a timely manner first. If no express, separate written cancellation of the pending Online Shop order is received from the customer Parts World will ship the merchandise when all the items of the order are available for delivery.
RESTRICTIONS APPLICABLE TO RIZOMA, PERFORMANCE MACHINE AND ARLEN NESS PRODUCTS
These brands are not available for delivery to all of the countries listed. Please contact us in individual cases for more information.
WARRANTY COVERAGE AND LIABILITY
When lodging any warranty claims you must furnish written proof of purchase including the date of purchase. Any and all warranty claims shall be null and void in the event that this cannot be furnished.
Warranty claims based on defective products and other items ordered in the Online Shop are to be lodged with Parts World immediately, the customer being entitled to performance under warranty as follows: complaints due to obvious defects are to be lodged in writing with Parts World within 10 days of delivery or receipt of the ordered product. Any latent defects are to be reported in writing within two months upon delivery or receipt. For justified complaints that are lodged in a timely manner, Parts World will, at its discretion, provide a replacement free of charge or remedy/remove the defect. Parts World shall be granted a suitable period of time for this of at least eight weeks. In the event that a defect cannot be remedied by way of repair or replacement delivery, the purchaser shall be entitled to demand a reduction in the purchase price or a rescission of the purchase contract.
Warranty does not extend to electronic components like blinkers, license plate lights, etc.; they are excluded from coverage. A reduced warranty applies to chrome parts and components, the warranty applying to the component itself but not the chrome plating/finish.
Any other claims extending beyond the aforementioned coverage are excluded as provided for by law. In no event shall Parts World be liable for any incidental, special, indirect or consequential damage whatsoever (including damages for loss of business profits, business interruption, non-realized earnings, or any other pecuniary loss). The warranty coverage and performance specified herein shall apply in lieu of the warranty entitlement and associated claims for compensation provided for in the Swiss Code of Obligations [OR].
Prior to returning any items purchased in the Online Shop, please contact us first via e-mail for a return delivery number.
DECLARATIONS / DRAWINGS / IMAGES, ETC.
We reserve the right to adapt product texts, images/graphics and/or declarations pertaining to individual products at any time as we deem fit. Parts World disclaims any and all warranty for technical descriptions / content. In the event that you combine other third-party products (except for those listed in the Online Shop) with Parts World components, no liability can be assumed by us for the proper functioning, installation, etc. Please contact us in individual cases via e-mail prior using these third-party components.
COPYRIGHT OF LOGOS AND OTHER IMAGE AND TEXT CONTENT
All images and copyrights are the property of Parts World AG. In the event that you would like to use graphics / texts / downloads / videos or logos from our shop, please be advised that any use by you is subject to Parts World's prior written consent.
NON-AUTHORIZED RETURN OF MERCHANDISE / REJECTION OF DELIVERIES
Rejecting deliveries is subject to a cancellation fee of no less than US$ 25.00 or EUR 25.00 per individual case, in addition to payment of return shipping costs. An additional fee of 20% of the merchandise value is also payable.
In the event that you return merchandise to us without the return delivery number, acceptance of your shipment will be rejected. Consequently, make sure to always request a return delivery number before returning any merchandise.
TRADEMARKS, BRAND NAMES AND OTHER DESIGNATIONS
Aprilia, Harley-Davidson, BMW, Ducati, Honda, Suzuki, Kawasaki, KTM, Yamaha, and model names like "R1", "GSXR", "V-Rod", "Fat Bob", etc. are registered trademarks and are used exclusively for reference purposes in the Online Shop. Designated trademarks and brands are the property of their respective owners. These trademarks and designations are not related in any way to Parts World.
RETENTION OF TITLE
We retain title to the merchandise until all payments hereunder are received in full.
GOVERNING LAW / VENUE
All legal relations associated with orders and deliveries via the Online Shop of Parts World shall be governed by and construed exclusively in accordance with the laws of Switzerland, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
The courts of Lohn-Ammannsegg, Switzerland, shall have exclusive jurisdiction with regard to any and all disputes arising from or in connection with this Agreement.
